World-leading anthropologists and philosophers pursue the perplexing question fundamental to both disciplines: What is it to think of ourselves as human? Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. With the outbreak of severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2), global researchers were confronted with major challenges. The German National Pandemic Cohort Network (NAPKON) was launched in fall 2020 to effectively leverage resources and bundle research activities in the fight against the coronavirus disease 2019 (COVID-19) pandemic. We analyzed the setup phase of NAPKON as an example for multicenter studies in Germany, highlighting challenges and optimization potential in connecting 59 university and nonuniversity study sites. We examined the ethics application (...) process of 121 ethics submissions considering durations, annotations, and outcomes. Study site activation and recruitment processes were investigated and related to the incidence of SARS-CoV-2 infections. For all initial ethics applications, the median time to a positive ethics vote was less than two weeks and 30 of these study sites (65%) joined NAPKON within less than three weeks each. Electronic instead of postal ethics submission (9.5 days (Q1: 5.75, Q3: 17) vs. 14 days (Q1: 11, Q3: 26), p value = 0.01) and adoption of the primary ethics vote significantly accelerated the ethics application process. Each study center enrolled a median of 37 patients during the 14-month observation period, with large differences depending on the health sector. We found a positive correlation between recruitment performance and COVID-19 incidence as well as hospitalization incidence. Our analysis highlighted the challenges and opportunities of the federated system in Germany. Digital ethics application tools, adoption of a primary ethics vote and standardized formal requirements lead to harmonized and thus faster study initiation processes during a pandemic. (shrink)

In face of the multiple controversies surrounding the DSM process in general and the development of DSM-5 in particular, we have organized a discussion around what we consider six essential questions in further work on the DSM. The six questions involve: 1) the nature of a mental disorder; 2) the definition of mental disorder; 3) the issue of whether, in the current state of psychiatric science, DSM-5 should assume a cautious, conservative posture or an assertive, transformative posture; 4) the role (...) of pragmatic considerations in the construction of DSM-5; 5) the issue of utility of the DSM – whether DSM-III and IV have been designed more for clinicians or researchers, and how this conflict should be dealt with in the new manual; and 6) the possibility and advisability, given all the problems with DSM-III and IV, of designing a different diagnostic system. In the conclusion to this multi-part article I first review the discussions carried out around the six essential questions in psychiatric diagnosis – the position taken by Allen Frances on each question, the commentaries on the respective question along with Frances’ responses to the commentaries, and my own view of the multiple discussions. In this review I emphasize that the core question is the first – what is the nature of psychiatric illness – and that in some manner all further (...) questions follow from the first. Following this review I attempt to move the discussion forward, addressing the first question from the perspectives of natural kind analysis and complexity analysis. This reflection leads toward a view of psychiatric disorders – and future nosologies – as far more complex and uncertain than we have imagined. (shrink)

In books on the calculus of probability, there have been many accounts as to what is the meaning of the term “probable.” We can readily divide them into three groups. The first sometimes defines probability in terms of the ratio between the number of cases favorable to an event and the number of equally possible cases. Sometimes probability is defined in some way other than this, but the above formulation, or one similar to it is used to describe the “measure (...) of probability.” This concept is what is called “the classical concept” of probability and was held by the great workers in the field of probability from the beginning of the eighteenth and opening of the nineteenth centuries, including James Bernoulli, Thomas Bayes, and the Marquis de Laplace. The second conceives of probability as a logical relation between hypothesis and evidence. Following this conception, one could identify “probability” with “degree of confirmation.” We will term this the “logical concept.” The third group identified probability with the relative frequency with which a property occurs in a specified class of elements. Some theories of goodness are descriptively rich: they have much to say about what makes things good. Neo-Aristotelian accounts, for instance, detail the various features that make a human being, a dog, a bee good relative to facts about those forms of life. Famously, such theories of relative goodness tend to be comparatively poor: they have little or nothing to say about what makes one kind of being better than another kind. Other theories of goodness—those that take there to be (...) absolute goodness—are comparatively rich: they offer grounds for judging some types of things better than others because they have more absolute goodness. Moorean accounts, for example, can tell us that humans and human experiences are superior to bees and blades of grass. But such theories tend to be descriptively poor: they struggle to tell us in virtue of what this is so. In this essay we motivate and flesh out a view that splits the difference between accounts of goodness as relative and accounts of goodness as absolute. Such a view holds promise only if the mechanics of this kind of metaphysics of goodness can be worked out. Here we present a view on which the paradigm for absolute goodness is God and the paradigm for each kind of relative goodness is a divine idea. (shrink)

Ethical internalism is a view that links an agent's reasons to be moral with his or her motivation to be moral. At least two kinds of ethical internalism can be distinguished. "Socratic" ethical internalism is the view that an agent cannot think he has a moral reason to perform some action unless he has some motivation so to act. "Humean" ethical internalism is the view that moral reasons give genuine reasons for acting only when the action serves one of the (...) agent's desires or other "motivating" attitudes. I argue that neither Socractic nor Humean internalism is defensible. ;The central difficulty with Socratic internalism is that, if it can be tested at all, it involves the ascription of a desire, on the part of all competent agents, not to act immorally. But I argue that this "desire thesis" is itself unverifiable, so that the Socratic internalist thesis cannot be tested. These criticisms are applied to the views of R. M. Hare, H. A. Prichard, and Thomas Nagel. ;On the other hand, the Humean internalist, I argue, generally overstates the ability of agents to perceive and evaluate their own reasons for acting. This leads the Humean internalist wrongly to downplay the role of an agent's interests in determining his or her reasons for acting. I show how the views of the Humean internalist conflict with common-sense views about the ascription of reasons for acting, and apply the criticisms to the works of Philippa Foot, Bernard Williams, and Gilbert Harman. ;Finally, I develop an "externalist" account of reasons for acting. According of this account, the reasons properly ascribable to an agent do not depend in any essential way on the motivating attitudes that are ascribed to an agent. I argue that the externalist account best accords with our intuitions about the ascription of reasons for acting. And I conclude by examining the possibility of using the externalist account of reasons to justify the imposition of legal liability on agents. (shrink)

Rawdon Wilson's "On Character" raised a great many questions, and I should like to deal with lesser matters before going on to those of more consequence. He has found in my work the Fallacy of Novelistic Presumption. To commit this unnatural act is to assume "that the novel possesses a history that is independent of other modes of fiction and that it may be discussed independently of the history of literature." Let me say at the outset that I am not (...) trying to frame a restrictive definition of the novel. Novels are whatever most critics agree to call novels, and if I speak of "the novel" I can only hope that the phrase will be taken as convenient shorthand rather than an attempt to define an essence. And of course the novel has a history of its own, just as the state of Connecticut has a history even as it remains one of the fifty states, just as literature has a history although it is only one of the arts or institutions of our culture. Mr. Wilson wants a theory of characters that "will necessarily account for - go to the heart of - all instances of character, symbolic, allegorical, naturalistic, whether in the novel, in epic, in romance, in drama, or in lyric." To that I can only reply with E.M. Forster's sentence: "We must exclude someone from our gathering, or we shall be left with nothing." In this essay Martin Price, Thomas E. Donnelley Professor of English at Yale University, responds to Rawdon Wilson's "On Character" which raised objections to Price's "People of the Book: Character in Forster's A Passage to India". In a letter to M. Coray, Thomas Jefferson distinguished two distinct notions of political authority. The first was that of ancient Greece, which was characterized by “slavery” and the subjection of the population. Jefferson’s characterization was astute insofar as Aristotle regarded some groups as privileged to rule “by nature,” while all other hereditary groups were fit only to be ruled. The second type, referring to governments of “the present age,” rejected that standard in favor of equality and the promotion (...) of the people’s “happiness.” Unexpectedly, the dichotomy between hereditary privilege systems and egalitarian service to the people maps onto the contrast between “feudal” and “bureaucratic” systems in late imperial Chinese theory. In other words, this insight into the nature of authority was known to theorists both in China and in the “West,” suggesting that it captures something fundamental about the nature of “authority.” This essay probes the dichotomy in two ways, theoretical and historical. In theory, “feudal” systems, east and west, seem to be informed by a substance metaphor, and so both Aristotle and his early modern followers conflated authority with social status, and imagined the latter as a hereditary, noble substance such as gold. In this model, social groups are necessarily ranked, with gold being nobler, for instance, than brass. Because authority inheres in the person as a substance, authority is personalistic. In other words, there is no clear, external standard for checking abuses of power. Classical Chinese bureaucratic theory imagined authority as a tally. In that case, an officer’s performance had to match the office’s public charge. Because the assignment of office is merit-based, tally systems tend to be more egalitarian. Moreover, they naturally provide an external standard for checking abuse, namely, the officer’s effect on the people’s “happiness.” Historically, these two paradigms clashed in England and Europe during the seventeenth and eighteenth centuries, when translations of Chinese texts became available. Using translingual analysis, this essay traces the transformation of authority from a substance model to a tally model in the thinking of several Enlightenment writers, culminating in the writings of Thomas Jefferson. By analogy to justifications offered for craniotomy by Catholic moralists (e.g., Germain Grisez and Rev. Martin Rhonheimer), a recent instance of casuistry (by the moral theologian M. Therese Lysaught) attempts to apply double-effect reasoning and, separately, the concept of a vital conflict to justify dilation and curettage in order to preserve the life of a pregnant woman. This Element defends a version of the classical theory of divine ideas, the containment exemplarist theory of divine ideas. The classical theory holds that God has ideas of all possible creatures, that these ideas partially explain why God's creation of the world is a rational and free personal action, and that God does not depend on anything external to himself for having the ideas he has. The containment exemplarist version of the classical theory holds that God's own nature is the (...) exemplar of all possible creatures, and therefore that God's ideas of possible creatures are in some sense ideas of himself. Containment exemplarism offers a monotheism fit for metaphysics, insofar as it is coherent, simple, and explanatorily powerful; and offers a metaphysics fit for monotheism, insofar as it leaves God truly worthy of the unconditional worship which Christians, along with Jews and Muslims, aspire to offer to God. This paper examines some aspects of Spinoza's metaphysics of the essences of modes.2 I situate Spinoza's use of the notion of essence as a response to traditional, Aristotelian, ways of thinking about essence. I argue that, although Spinoza rejects part of the Aristotelian conception of essence, according to which it is in virtue of its essence that a thing is a member of a kind, he nevertheless retains a different part of such a conception, according to which an essence is (...) some structural feature of a thing which causally explains other, non-essential features. I go on to develop an account of Spinoza's metaphysics of essence, according to which essences, what he sometimes calls formal essences, are produced by the divine essence prior to and independent of the creation of finite modes, and according to which essences are the formal or exemplar causes of finite modes. I then argue that finite modes, in virtue of the formal essences which they actualize, are genuine causal relata. Finally, I offer some speculations about Spinoza's answer to the question, "Why, in a necessitarian cosmos filled with formal essences, should there be temporal finite modes at all?". (shrink)

Ward examines Scotus's arguments for his distinctive version of hylomorphism, the view that at least some material objects are composites of matter and form. It considers Scotus's reasons for adopting hylomorphism, and his accounts of how matter and form compose a substance, how extended parts, such as the organs of an organism, compose a substance, and how other sorts of things, such as the four chemical elements and all the things in the world, fail to compose a substance. It highlights (...) the extent to which Scotus draws on his metaphysics of essential order to explain why some things can compose substance and why others cannot. In his ethical writings, Duns Scotus emphasized both divine freedom and natural goodness, and these seem to conflict with each other in various ways. I offer an interpretation of Scotus which takes seriously these twin emphases and shows how they cohere. I argue that, for Scotus, all natural laws obtain just by the natures of actual things. Divine commands, such as the Ten Commandments, contingently track natural laws but do not make natural laws to be natural laws. I present textual (...) evidence for this claim. I also show how this view of Scotus on the natural law is consistent with a number of troubling passages. Scotus’s ethical theory implies that there are genuinely moral reasons for acting which are not absolutely binding (because subject to a divine command or permission otherwise) and also some moral reasons for acting which are absolutely binding (because not thus subject). This article presents a new interpretation and critique of some aspects of Aquinas’s metaphysics of relations, with special reference to a theological problem—the relation of God to creatures—that catalyzed Aquinas’s and much medieval thought on the ontology of relations. I will show that Aquinas’s ontologically reductive theory of categorical real relations should equip him to identify certain relations as real relations, which he actually identifies as relations of reason, most notably the relation of God to creatures.
